1. Agreement to these terms
These Terms & Conditions ("Terms") govern your access to and use of the Flashcard RPG mobile and web applications and this website (together, the "Service"), operated by Flashcard RPG Pty Ltd (ACN 701 026 413, ABN 15 701 026 413) of Se17, 89-97 Jones St, Ultimo NSW 2007, Australia ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be old enough to use the Service in your country and to consent to the processing of your data. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. You are responsible for the accuracy of the information you provide.
3. Your account
Sign-in is provided through Google and Apple β there are no passwords managed by us. You are responsible for activity that happens under your account and for keeping access to your sign-in provider secure. Notify us at support@flashcardrpg.com if you believe your account has been accessed without permission.
4. Subscriptions & payments
The core app is free to use. Optional paid plans (such as "Pro") unlock additional features. Paid subscriptions are billed through the Apple App Store or Google Play, and are subject to those stores' terms. Subscriptions renew automatically unless cancelled before the end of the current period; manage or cancel renewal in your app-store account settings. Prices may change with notice, and taxes may apply. Except where required by law or store policy, payments are non-refundable.
5. Virtual items & in-game currency
The Service includes virtual currencies (such as gold and gems) and virtual items (such as equipment and pets). These are a limited, personal, non-transferable licence to use them inside the Service. They are not your property, have no cash value, cannot be sold or exchanged outside the Service, and cannot be redeemed for money except where the law requires it. We may change, rebalance, or discontinue virtual items and currencies as the game evolves. Unused virtual currency and items are forfeited when your account is closed.
6. Your content
You may create decks, cards, recordings, and other content ("Your Content"). You keep ownership of Your Content. You grant us a limited licence to store, display, and process it as needed to operate the Service (for example, to sync it across your devices and, if you choose to publish a deck, to make it available in the library). You are responsible for Your Content and confirm you have the rights to use it.
7. Acceptable use
Don't misuse the Service. In particular, don't break the law, infringe others' rights, upload harmful or offensive content, attempt to disrupt or reverse-engineer the Service, cheat or manipulate game progression, or access the Service through unauthorised means. We may suspend or remove content or accounts that violate these Terms.
8. Fair play & enforcement
The game is competitive, so we take cheating seriously. If we reasonably believe you have cheated, exploited a bug, automated play, or otherwise breached section 7, we may take any of the following steps, in proportion to what happened: remove virtual currency and items obtained through that conduct, or bought with currency obtained through it; reverse the affected progression, levels, or leaderboard placements; restrict access to particular features; or suspend or terminate your account. Purchases you made with real money are treated separately and are subject to section 4 and to your rights under consumer law. If you think we have got it wrong, email us at support@flashcardrpg.com and a person will review the decision.
9. Intellectual property
The Service, including its software, artwork, characters, and branding, is owned by Flashcard RPG Pty Ltd or its licensors and is protected by intellectual-property laws. These Terms don't grant you any rights to our branding or content except as needed to use the Service normally.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. Flashcard RPG is a study and entertainment product; we don't guarantee particular learning outcomes, exam results, or uninterrupted availability.
11. Limitation of liability
To the maximum extent permitted by law, Flashcard RPG Pty Ltd will not be liable for indirect, incidental, or consequential damages, or for loss of data or progression, arising from your use of the Service. Nothing in these Terms limits rights that cannot be limited under applicable law.
12. Termination
You may stop using the Service at any time and request deletion of your account. We may suspend or end your access if you breach these Terms or if we discontinue the Service. Some provisions survive termination, including sections on content licences, intellectual property, disclaimers, and liability.
13. Changes to these terms
We may update these Terms from time to time. If we make material changes, we'll take reasonable steps to let you know. Continuing to use the Service after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law rules.
